Home : About Anapol Schwartz Benefits of Retaining Anapol Schwartz, Medical Malpractice LawyersAnapol, Schwartz, Weiss, Cohan, Feldman & Smalley, P.C. is a multi-faceted law practice with offices in Pennsylvania and New Jersey. Anapol Schwartz maintains a tradition of excellence in medical malpractice for cases harming newborns, children and adults; pharmaceuticals, class actions, personal injury and wrongful death, product liability and automobile litigation. Too numerous to list, here is a partial list of the medical malpractice settlements involving babies and children: $9.6 million: Attorney Alan Schwartz earned a $9.6 million verdict in a case involving a profound birthing injury during labor. $2.1 million: Attorney Jim Ronca earned a $2.1 million verdict in a case involving the wrongful death of a 4-year-old boy who was admitted to a Pennsylvania hospital for respiratory distress caused by pneumonia. Attending doctors did not timely evaluate and transfer the boy. The case against the hospital was confidentially resolved prior to verdict after an eight-day trial. A second claim against one of the anesthesiologists resulted in a finding of negligence but the jury did not attribute factual cause to that defendant. $800,000 for Shoulder Dystocia: Attorney Alan Schwartz settled a confidential case involving a newborn with a shoulder dystocia delivery. The baby was delivered by an unsupervised second-year resident with one shoulder not entering the pelvis during birth which leads to complications for both baby and mother. Although the doctor was summoned, he didn't arrive in time. The baby's head was pulled with excess force, resulting in a Brachial Plexus injury. Brachial Plexus is nerve damage with symptoms that include a limp or paralyzed arm; lack of muscle control in the arm, hand, or wrist; and lack of feeling or sensation in the arm or hand. The child had an initial operation and will have others to repair the nerve damage and deformity of the non-dominant arm and hand. The $800,000 settlement was decided before trial. Has your baby been the victim of life-altering birth delivery practices? You could be eligible for an Erbs Palsy lawsuit. Every state has a different time limit or statute of limitations for filing a lawsuit. In Pennsylvania, the statute of limitations is two years for wrongful death, personal injury, and medical malpractice lawsuits but for minors, the statute of limitations is still within two years. In New Jersey, the same applies. Is an Erbs Palsy lawsuit right for you?Your best option is to retain a law firm who has solid experience in birth injuries. Please tell us what happened. All your information is kept confidential and you are under no obligation to proceed. After we receive your information, it will be reviewed by our attorneys to determine whether or not Anapol Schwartz law firm can help you. At this point - we have not agreed to represent you - and more importantly, you have not yet agreed to retain us.
